Terms and conditions of service

The shipper, on behalf of themselves or anyone involved in the shipment, agrees that the following terms and conditions will apply once SME Shipping accepts the shipment, unless otherwise agreed in writing to an authorized officer of SME Shipping. "Shipping" means all documents and packages sent as per the shipping manifest, which SME Shipping may choose to send by any method—air, road, or other means of transport. SME Shipping acts as a freight forwarder between the shipper and any transport company, hereinafter referred to as the "Shipping Company," designated by the shipper or as deemed appropriate by SME Shipping. The transportation of all items will be carried out under the basic liability limited as specified herein. If the shipper requires greater security for the shipment, additional insurance can be paid for (please see details below).

    1. Customs Import and Export SME Shipping has assigned the shipping company to perform the following services on behalf of the shipper: (1) complete documentation, amend product or service codes, and pay duties and taxes in accordance with applicable laws; (2) act as the shipper's agent in carrying out various customs procedures and export controls, and as the consignee in cases where the purpose is to appoint a tax broker to perform customs procedures and entries; (3) connect the shipment to the consignee's import broker or to any other address as required by any person deemed appropriate by the shipping company.
    2. Shipments Not Accepted for Service: The shipper acknowledges that their shipment is acceptable for transport, but a shipment will not be accepted for service if: – The shipment belongs to the category of dangerous goods and hazardous materials, including prohibited or controlled materials according to the regulations of IATA (International Air Transport Agency), ICAO (International Civil Aviation Organization), ADR (European Regulation on the Transport of Dangerous Goods); – Any government agency or other relevant organization has not declared details to customs when required by applicable customs regulations; – The shipment contains counterfeit goods, food and drugs, animals, gold bullion, currency, tax labels, negotiable instruments bearing the name of the holder, precious metals or stones, real and replica firearms and their components, explosives and ammunition, human remains, obscene materials, or illegal narcotics/drugs; – The shipment contains any other items that SME Shipping determines cannot be safely or legally shipped; or – The packaging of the shipment is defective and insufficient for transport.
    3. Delivery and Non-Delivery Cases: SME Shipping cannot accept deliveries to post office boxes or by zip code. Deliveries will be made to the recipient's address as specified by the sender, regardless of the recipient's name provided. For deliveries where the delivery address is a designated central area, items will be delivered to that area.

      If a shipment is deemed unacceptable for service, or the value of the item is undervalued for import tax purposes, or there is no recipient or address as specified, or the recipient refuses to accept the shipment or refuses to pay import duties and customs fees, the shipping company may use appropriate means to return the item to the sender. The sender will be responsible for all costs of the return (including return shipping costs, import duties, and any fees incurred in the return process). Alternatively, if the shipment is seized by customs, or if the shipping company is unable to contact the recipient within the specified timeframe or within 7 days of arrival at the destination, the shipment will be returned or destroyed. SME Shipping shall not be liable for any losses to the sender or anyone else involved in the shipment.
    4. Inspection agencies for SME shipping companies and forwarding firms have the right to open and inspect shipments without prior notice.
    5. SME Shipping's shipping costs are calculated based on actual weight and volume, whichever is higher. SME Shipping may re-weigh and re-measure all shipments to confirm the shipping cost calculation. The shipper must pay or refund SME Shipping for shipping costs, equipment costs, customs duties, and any other services or actions performed by SME Shipping on behalf of the shipper, recipient, or third party, including any claims, damages, fines, and expenses incurred if the shipped items are found to be unacceptable for service as defined in Clause 2.
    6. SME Shipping's liability is limited to direct loss and damage only. Any loss and damage beyond this is deemed ineffective, such as loss of profits, income, interest, and future business, regardless of whether such loss and damage was indirect or exceptional, or even if the risk of such loss and damage was acknowledged by SME Shipping either before or after consent to ship. SME Shipping's liability for any shipment, without affecting Clause 7-11, shall be limited to the actual cash value incurred.

      SME Shipping's liability for transportation operations within Thailand, in the event of incidents occurring during transit from the sender to SME Shipping's Thailand office, is limited to 1,000 baht per delivery address for damages and losses.

      For shipments handled by forwarding companies from SME Shipping Co., Ltd., liability for damage and loss is limited to 600 THB per kilogram for international air express delivery services, and 300 THB per kilogram for international land express delivery services, and 1,000 THB per delivery address for registered international air parcel post services. Claims are limited to one claim per shipment, subject to a complete and final agreement regarding the associated loss and damage. If the shipper deems these limitations insufficient, they may issue a value-declared declaration and request special shipping insurance as specified in Clause 8 (Shipping Insurance) or arrange their own shipping insurance; otherwise, the shipper shall bear all risk of loss and damage.
    7. Claims for damages: All claims must be in writing and sent to SME Shipping within 15 days of the date SME Shipping accepts the shipment. Otherwise, SME Shipping will not be liable for anything.
    8. SME Shipping Insurance can arrange shipping insurance for shippers. This insurance covers the actual cash value in the event of loss or damage to shipped items. Shippers must complete the insurance section at the top of the shipping invoice and pay the insurance premium. Shipping insurance does not cover indirect loss or damage, or loss or damage caused by delays.
    9. Regarding delayed shipments and refund guarantees, SME Shipping has made reasonable efforts in all cases to fulfill deliveries according to SME Shipping's normal schedule. However, this schedule is not binding and is not part of the agreement. SME Shipping will not be liable for any loss or damage whatsoever resulting from these delays.
    10. Situations Beyond SME Shipping's Control: SME Shipping shall not be liable for loss or damage caused by any event beyond its control, including electrical and magnetic damage, or erasure of electronic images and photographs, data, recorded information, defects, or any other inherent characteristics of the shipped items, even if SME Shipping is aware of such events. This also includes the actions or omissions of any third party not employed or contracted by SME Shipping, such as shippers, consignees, third parties, customs and government agencies, and force majeure events such as earthquakes, cyclones, storms, floods, fog, war, plane crashes, port shutdowns, protests or civil unrest, and industry actions.
    11. International conventions dictate that if a shipment is by air and its final destination or stop is in a country other than the country of origin, the Montreal Convention or the Warsaw Convention shall apply. For international transport, the Common Freight Forwarding (CMR) Agreement may be used. These agreements and conventions limit liability for loss or damage.
    12. The shipper's guarantee and protection shall protect SME Shipping from any loss or damage resulting from the shipper's failure to comply with applicable laws and regulations, including breaches of guarantees and the following actions: All information obtained from the shipper or their agent must be complete and accurate. Shipments must be prepared in a secure location by the shipper's personnel. The shipper must use trusted staff in preparing shipments. The shipper must protect shipments from unauthorized interference during preparation, storage, and transportation to SME Shipping. The destination address must be accurately identified and communicated, and the shipment must be properly packaged to ensure safe transport, with proper care and handling.
    13. The shipper agrees to the route and route changes, including the possibility that the delivery will need to pass through intermediate stops.
    14. For shipments that cannot be delivered for whatever reason, the sender must reclaim the shipment within 14 days of the date SME Shipping accepts the delivery. After this period, SME Shipping will not be responsible for any loss or damage that may occur.
    15. Laws applicable to the benefit of SME shipping: Any disputes arising under or in relation to these terms and conditions shall be settled in the jurisdiction and enforcement of the laws of the country of origin of the shipment, and the shipper shall comply with such decisions unless it conflicts with applicable laws. General safety protocols for transportation are maintained.
    16. Any invalidation, voidness, or non-enforcement of any provision shall not affect the rest of these Terms and Conditions.
